Agreement to Terms

By accessing and using the AffordableStartup website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use my services.

Services Description

AffordableStartup provides software development consulting services, including:

• Custom web application and SaaS platform development
• Mobile application development for iOS and Android
• Technical consulting and architecture advice
• MVP development and prototyping
• Code review and optimization services

Consultation Process

Initial Consultation

• Free initial consultation to understand your project needs
• Project scope and timeline discussion
• Technology recommendations and architecture advice
• Fixed-price quote based on defined requirements

Project Agreement

• Detailed project proposal with scope, timeline, and pricing
• Written agreement required before work begins
• Payment terms and milestone schedule
• Change request process and additional costs

Payment Terms

Pricing Structure

• Starter Package: $2,500 - $4,000 (50% upfront, 50% on delivery)
• Professional Package: $5,000 - $8,000 (30% upfront, 40% at milestone, 30% on delivery)
• Extended Package: $8,000 - $12,000 (25% upfront, milestone-based payments)

Payment Conditions

• Payment due within 14 days of invoice
• Late payments may incur 1.5% monthly interest charges
• Work may be suspended for overdue payments
• No refunds for completed work or time invested

Project Scope and Changes

Scope Definition

All projects begin with a clearly defined scope document that includes:

• Specific features and functionality to be delivered
• Technology stack and deployment requirements
• Timeline and milestone schedule
• Exclusions and out-of-scope items

Change Requests

• Changes to agreed scope must be requested in writing
• Additional costs and timeline impacts will be provided
• Work on changes begins only after written approval
• Minor adjustments may be included at my discretion

Intellectual Property

Client Ownership

Upon full payment, you own all custom code and assets created specifically for your project, including:

• Source code and database schemas
• Custom designs and graphics
• Project documentation
• Deployment scripts and configurations

Retained Rights

• General methodologies, techniques, and know-how
• Reusable code libraries and frameworks
• Third-party libraries and open-source components
• Right to showcase work in portfolio (with permission)

Confidentiality

I respect the confidentiality of your business information and agree to:

• Keep all project information strictly confidential
• Not disclose business strategies or sensitive data
• Use information solely for project delivery
• Return or destroy confidential information upon request
• Sign additional NDAs when required

Deliverables and Support

Project Delivery

• Code delivered through version control systems (Git)
• Documentation provided for maintenance and deployment
• Testing and quality assurance included
• Basic training on system usage if required

Post-Delivery Support

• Bug fixes included for specified period (varies by package)
• Support for deployment issues within 30 days
• Additional features and enhancements quoted separately
• Emergency support available at premium rates

Warranties and Disclaimers

Limited Warranty

• Code will be free from material defects at delivery
• Work will substantially conform to agreed specifications
• Applications will function as designed in specified environments
• Warranty period varies by package (2 weeks to 3 months)

Disclaimers

Except for the limited warranty above, services are provided "as is" without other warranties. I do not guarantee:

• Uninterrupted or error-free operation
• Compatibility with all third-party services
• Performance in all possible environments
• Business success or revenue generation

Limitation of Liability

To the maximum extent permitted by law, my liability for any claims related to these services is limited to:

• The total amount paid for the specific project in question
• Direct damages only (no indirect, consequential, or punitive damages)
• Claims must be made within 12 months of project completion

I am not liable for damages caused by third-party services, hosting issues, or factors beyond my control.

Termination

Termination by Client

• 7 days written notice required
• Payment due for all completed work
• Delivery of work completed to date
• No refund for upfront payments

Termination by Developer

• Right to terminate for non-payment or breach of terms
• 7 days notice for non-payment issues
• Immediate termination for serious breaches
• Refund of unused prepaid amounts (if any)

Force Majeure

I am not liable for delays or failure to perform due to circumstances beyond reasonable control, including natural disasters, government actions, internet outages, or other unforeseeable events.

Governing Law

These terms are governed by the laws of the jurisdiction where I am located. Any disputes will be resolved through binding arbitration or in the appropriate courts of that jurisdiction.

Modifications

I reserve the right to modify these terms at any time. Changes will be posted on this page with an updated date. Continued use of services after changes constitutes acceptance of new terms.

Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
